Our Contracts, Screening Form, Addendums are all legally binding documents. For ease of reading, we use the following abbreviations: Candy's Cats, Inc. (CCI, which shall include the organization or its agents or volunteers) , Temporary Foster Parent (TFP).

The first cat I am adopting is



Pre-Spay/Neuter Adoption

The approved referenced adoption between CCI, and the approved adoption applicant, who for the purpose of this addendum shall be called the Temporary Foster Parent(s) (TFP), for the adopted kitten(s) hereinafter, kitten(s) listed in this Adoption Contract is subject to these additional terms and conditions: 

The TFP acknowledges that this is a legally binding and enforceable agreement and is governed by the laws of the state of Florida. 

The TFP will take custody and full responsibility for the kitten(s) effective the date of this Addendum. 

The TFP agrees to care for the kitten(s) and assume all responsibility for their care, feeding, and veterinary care. 

The prevailing adoption fee will be paid at the time the TFP takes custody of the kitten(s). We will only provide spay/neuter services through the veterinary partners of CCI at our expense as part of the adoption fee. The TFP is responsible for transporting the animal to and from said appointment. Kitten(s) can be fixed as soon as they weigh a minimum of 2 pounds and must be fixed not later than 16 weeks of age, unless a medical/health concern precludes the surgery in which CCI will direct proper care. 

The TFP agrees to home visits by CCI, with reasonable notice of 24 hours by text or telephone call.

If the TFP elects to use a veterinarian outside of CCI’s partners, the TFP assumes all associated costs of the spay/neuter and other required medical care such as vaccinations. The TFP agrees to provide documentation or gives consent to the veterinary provider to release information of spay/neuter surgery, rabies vaccinations, routine feline vaccinations, deworming, or other medical procedures performed upon request of CCI. 

CCI agrees to finalize the adoption of the kitten(s) once proof of vaccinations and spay/neuter is received and confirmed by CCI. 

The TFP agrees this agreement is enforceable and binding without notice or process – which means - if this Addendum is breached or violated the TFP will immediately relinquish kitten(s) to CCI and the adoption fee(s) will be forfeited. 

The TFP acknowledges that in the event of a breach of this Addendum, the adopted kitten(s) belong to CCI and thereby gives permission to CCI to pick the adopted kitten(s) up or that the TFP will safely return the kitten to CCI within 24 hours of request. 

The breach of this Addendum will result in denial of adoption petition and termination of foster status and the adopted kitten(s) will be taken back into CCI. 

There is no other recourse or remedy other than the return of the adopted kitten(s) to CCI for failure to comply with this Addendum. 

I agree to keep the cat(s) being adopted indoors only.

I will not declaw the cat at any time in the future, understanding that declawing is the painful amputation of the first knuckle and is a cruel practice to the cat, which may result in behavioral or physical problems in the future.

I understand that there may be undiagnosed and/or unknown diseases or medical problems that may be associated with or present in the animal I am adopting. the medical information provided to me is not necessarily certified by a veterinarian unless such certification is attached to the medical records, but that the information provided by CCI for the pet(s) that I am adopting is truthful to the best of their information, knowledge and belief. It is my responsibility to take the adopted animal to a veterinarian within ten (10) days of the adoption to check for diseases or medical conditions for those listed and other than those listed on the adoption attachment for which the animal has been treated or tested. Once the animal is in my care, and upon finalizing this Contract, I am fully responsible for all expenses and liability relating to the animal, including but not limited to, food, shelter, care and veterinary expense, including medicine. (See Addendum #1.)

I agree not to abuse, abandon or neglect the cat. I authorize CCI's representative to make premise inspection(s) to determine whether or not the cat has been abused or neglected and understand that any failure to follow this contract will constitute a breach of contract. In the event of any breach of contract, I authorize CCI to reclaim the possession, ownership and guardianship of the adopted cat. The adoption fee and any donation will be forfeited.

I agree not to abandon, give away, sell or dispose of the cat(s) in any way and to notify CCI immediately at any time I determine that I can no longer keep the cat(s). I agree to providing CCI the right of first offer and in good faith, to return the cat to CCI. A transfer of the cat to another family member or friend must be preapproved by CCI. My family member or friend will need to fill out a Screening Form and be approved to ensure that the cat will never be declawed or allowed to be an outdoor cat. (See Addendum #2).

If the cat(s) become lost for whatever reason, I will immediately notify CCI's representative as well as I will notify the local shelters, place a "generic" ad on Social Media, Craigslist and the newspaper. (Generic ad means that you do not put a picture on the ad. For animal services you must provide a picture of the cat.

Settling into a new home can be difficult for some cats. They may have been abandoned by their previous family, stuck in an overwhelming shelter environment for a period to then go to a completely different home with brand new caregivers. It’s understandable that some may need longer than others to adjust. If after the first day or two, the kitty is not eating or using the litter box, please email adoptions@candyscats.org with your concerns so we can help you with the transition. If the kitty is hiding under the bed, it can take much longer for it to feel safe. If you ultimately decide you cannot keep the pet, he or she can be returned to our rescue with advanced notice.

I understand that this Adoption Contract ("Contract") is legally binding.

The Adoption Screening Form is a multi-page document which will be incorporated into and made part of the Contract. CCI permits cats to go home the same day of the adoption but relies on the truthfulness of the answers provided. Falsification of any information on the Contract or Adoption Screening Form will void the Contract and CCI will arrange for the return of the cat(s) to CCI. CCI will use all legal remedies available to them to facilitate this return. If legal fees and costs are incurred, I understand that I will be responsible for those fees and costs, and any adoption fee or donation given to CCI will be forfeited.

CCI may require the return of the cat(s) at any time, if the information given here is deemed incorrect or if the animal(s) are not being cared for properly. I hereby confirm that the information supplied here is truthful. I am entering my full name.

ADDENDUM #1 Candy’s Cats makes every effort to adopt healthy cats and at the time of the adoption, we disclose any medical issues that your adopted kitten may have. Most of our rescue cats come to us with unknown medical issues. A common one is conjunctivitis (weepy eye) which may manifest itself after the adoption because of the stress of relocation or after visiting our adoption centers for several days. Paragraph 5 of our Contract states:

“I understand that there may be undiagnosed and/or unknown diseases or medical problems that may be associated with or present in the animal I am adopting. The medical information provided to me is not necessarily certified by a veterinarian unless such certification is attached to the medical records, but that the information provided by the Agency for the pet that I am adopting is truthful to the best of their information, knowledge and belief.

It is my responsibility to take the adopted animal to a veterinarian within ten (10) days of the adoption to check for diseases or medical conditions for those listed and other than those listed on the adoption attachment for which the animal has been treated or tested. Once the animal is in my care, and upon execution of this document, I am fully responsible for all expenses and liability relating to the animal, including but not limited to, food, shelter, care and veterinary expense, including medicine.”

All cats that are adopted through CCI are tested for feline leukemia and feline aids. We provide you with the test results at the time of testing. There is a 9-month window for either of these viruses to develop. The statistics are roughly less than 3% of cats will acquire either of them. We do not vaccinate for these viruses because there is no distinction between the FIV vaccine and the virus in future testing. Some of our adult cats may have been vaccinated prior to coming to our rescue and eventually the vaccine will leave its system.

Our cats are not tested for FIP, a rare but fatal virus. If your adopted cat acquires FIP within a year of the adoption, we will replace that cat for you at no charge with another, age appropriate cat within six (6) months after proof from veterinarian as to cause of death. FIP is a cat specific immune disorder and the testing is not accurate more than 70% of the time.

By signing this Addendum to the Adoption Contract, I understand that the cat may develop a weepy eye or other health issue, and it is my responsibility to take the cat to your vet for further evaluation. If I do not sign the addendum but sign the contract electronically, my electronic signature will suffice.

ADDENDUM #2 Candy’s Cats believes that when adopting one of our cats or kittens, that they become a family member and the adoption is a decision to keep the cat forever. It is always disappointing when it doesn’t work out that way. We recognize that there are times when you will not be able to keep the cat that you adopted from us. Our commitment in the adoption process is to the cat. If for any reason you are not able to keep the cat as part of your family, your contract states in Paragraph 8:

“I agree not to abandon, give away, sell or dispose of the Cat in any way and to notify CCI immediately at any time I determine that I can no longer keep the Cat. A transfer of the cat to a new family must be preapproved by CCI.”

We ask that you notify us in advance, do not wait until the last minute to contact us because we have to make arrangements for a foster home for the cat(s) you adopted.

It is very helpful that you have the medical paperwork that we gave to you at the time of the adoption, which is the cat(s)’ medical information. We have adopted over 7,000 cats and it’s very difficult to easily put our hands on the paperwork; providing us with the paperwork is helpful.

If you have someone who wants to make your adopted cat a part of their family, CCI reserves the right to meet with the new family in person and to have a new contract signed. Please have them complete our Adoption Screening Form and let us know when it's completed. By signing this Addendum, I state that I understand the terms of our Adoption Contract and will honor my commitment to your new family member.
